Owners and decoration companies negotiate contracts

General knowledge of decoration contract:
The owner commissioned the construction party to carry out the construction of his own home decoration project. It is through the "renovation contract" to restrain each other. The contract should at least indicate: the owner needs to "how much money? What kind of method to use for construction? What kind of quality level should be achieved? How long does it take? How to solve after the breach?
Another: The warranty period, the payment method, the rights, obligations, supplementary terms, and other factors of the two parties are equally important.
Both parties to the contract have the right to formulate contracts. But most of them are decoration companies that make contracts. You can also use the contract template of the relevant industry association. However, industry associations do not have the right to require both parties to perform the contract model. Therefore, both parties have the right to revise and supplement the terms of the contract model.
The contractor's agreement with the owner is reflected in the contract, but also in the "contract supplement terms, budget, construction plans", so do not take lightly on the budget. As an owner, you can't just care about the quotes in the budget. In fact, the comments behind the budget are equally important, as are the construction drawings.
Before signing the contract, the owner shall review the following documents: contract, supplementary clause, budget, construction drawings and renderings. Although the contractor will not allow the owner to sign the effect map, the owner must understand the materials and processes of all the construction projects to the constructor and then add these to the construction drawings.
What kind of degree has it with the company to sign a renovation contract?
At the very least, the general plan and important details of the design should be negotiated. After all the prices are negotiated and the contractor’s budget, contract, materials, drawings, and processes are all reviewed, consider what the owner needs to add. Considering the time, don't bother. If you sign a decoration contract, you will have more insurance.
If the design is not settled, the contract will be signed. The designer will no longer have to worry about the design plan. It can be simple and simple, and the owner's opinions will not be taken into consideration.
If the price is not negotiated, signing the contract means that you can no longer talk to the construction party about the price. For some projects, the designer has reason to raise the price. If you do not agree, you will not do it. If you agree, you will need a high price. (Because some items are not calculated in terms of area or meters, they are calculated in terms of "items." These unit prices without a standard are all estimated by the designer). In fact, one minute before signing the contract is also a good opportunity for bargaining.
There are documents such as materials, crafts, etc. If you haven't figured out how to go about it, sign the contract. After that, just wait to be fooled! People say what materials they use, and how they are constructed.
Before signing a contract with them, it is necessary to first review their decoration contract, it is necessary to take home a copy, first look at it, think about it, what additional terms need to be added, so as to effectively prevent future wrangling.
Can a renovation contract be changed? Can additional terms be added?
The answer is: There must be a right to request additional contract supplements.
Most of the reasons for the decoration company's refusal of the owner to add additional clauses to the contract are: "This is a contract issued by the Ministry of Construction. We have no right to change it." This is a misleading explanation.
The Construction Department and the Decoration Association are obliged to promote standard contracts, but they have no right to require both parties to the contract to fulfill the standard contracts. Therefore, the owner has the right to request additional supplements.
Second: In the standard contract of Henan Province, there is an increase in the supplementary clause. This item is included in the standard contract. Why can't it be added? Obviously unreasonable.
What supplementary provisions should we prepare for signing the renovation contract?
The decorating company's decoration contract is not immutable, and both sides of the contract have the right to supplement or amend some of the terms.
The focus of general coordination with decoration companies is:
Metering methods: In particular, the metering method for latex paints and the metering method for hydropower reforms.
Warranty period: The decoration company's general warranty is two years, there are also five years warranty for the company's hydropower reform, and five years for the waterproof warranty (a national state's regulations for management)
Construction process: For example: ceilings can require them to use light steel keels.
Acceptance criteria: The requirements for wall surface roughness can be written into the contract. Acceptance and acceptance according to the standard written on the contract.
Acceptance by stages: The general decoration company is divided into three inspections (hidden project, medium-term, and completion), and more acceptances can be proposed. The more acceptance stages, the more controllable the quality. After all, quality control depends on process control.
Default Clause: For example: What if using fake materials? How to solve the delay and so on. Only by taking all these factors into consideration can we effectively solve the problem of wrangling in the future. However, as the owner, it is impossible to consider such detailed information. Therefore, professional home improvement supervisors should be invited to serve themselves.
Does the construction process have to implement the standards in the contractor's contract?
There are many kinds of acceptance standards, and the acceptance standards in different places are also different. The acceptance standards of various companies are also not the same.
The general acceptance criteria are:

National standards: For example: Quality acceptance specifications for building decoration projects.
Local standards: For example: 97 standards in Shaanxi Province.
Design criteria: reflected in the budget note. For example: install the wood line, specification: 1*5.5 centimeters. The wall surface is less than 3mm flat and so on.
The company's internal standards: These standards are generally used to restrict the foreman and are not included in the budget. Just verbal promises, for these verbal commitments, the owners have the right to write these in budget notes or contract supplements. In general, the 97 standard in Shaanxi Province has been invalidated. It has taken too long and has not been upgraded. The standard is relatively loose. The constructor may be required to implement the National 2001 Standard.
Another national standard can not keep up with the times, and more advanced technologies are emerging. Therefore, it is possible to summarize more advanced technologies by themselves and present them in the form of supplementary clauses for the construction party to implement. This is also called: Design Standards.
Warranty period, quality standards, and breach clauses in the contract:
warranty period:
In the contract designed by the Shaanxi Provincial Department of Construction, the warranty period is one year, and now the company's warranty period is adjusted to two years.
In order to win customers, some companies have designed the warranty period for hydropower projects to be a five-year warranty. Others are two years.
In addition, one of the documents in the "Management Methods for Residential House Decoration" of the State stipulates that rooms with waterproof requirements shall have a waterproof warranty period of 5 years and other items of at least 2 years.
Quality Standard:
In Xi’an, most of the companies and owners signed the standard: 97 standards in Shaanxi Province, that is, the standards set in 1997, relatively backward, the standards are more general.
The standards that many foreign companies have signed with their owners are national standards (GB-2001) and local standards in other places.
The more advanced quality standards are: National Standard GB - 2001 series. The specific template can be browsed by the "contract, standard model" section of my station.
Breach of contract:
The decoration companies agreed to be more general, almost no restrictions on the decoration company, the biggest compensation clause is: delay, to pay the owners a penalty, even if the allocation is very small, 30,000 list, postponed for one day, at most one Twenty yuan/day.
Some contracts have also illustrated the environmental protection. If the environmental protection is not up to the standard, the decoration company must carry out the rework according to the agreement until reaching the standard.
Therefore, if the owner has special requirements for certain projects (for example, quality or duration), special requirements will be required and the breach clauses will be detailed so that there will be pressure on the decoration company.
How much do you know about the payment method in the decoration company contract?
The payment methods in general decoration company contracts are: deposit, first period, middle period, and final payment. After signing the contract, you should pay the deposit or the first payment. This depends on how the owners talked to the company.
The first period: 60%, the medium period: 35%, the last payment: 5%, and the increase or decrease will be settled in the interim period.
The first period is generally after the signing of the contract and before the bottom is reached.
The mid-term is generally paid after the carpentry is over, the mason comes into play, or the mason finishes, the carpenter closes, and the painter enters the market.
Final payment: Naturally, after the acceptance, the maintenance is over and the final payment will be paid.
Of course, all can be coordinated. With regard to the first phase, the amount of money is relatively large. Many companies can coordinate the payment as "the first payment in two payments." The progress of the payment is basically unchanged, that is, the first payment is only 30%. 30% before the end of the mason's entry into the field, and no change thereafter.
The first payment period that I have seen is relatively late: the first payment is made, all drawings are made, and after the engineering department assigns the foreman, all the staff only pay the first payment when they reach the bottom. This method is regarded as payment comparison. Even late, even after the arrival of the material, the first payment will be handed over to the company. Ha ha! This depends on how the owners talked with the company. Of course, when meeting some large companies, the room for coordination is much smaller. Large companies generally do not pay the first payment, and the engineering department does not have a single (not to order the foreman, let alone make it to the bottom. )).
As for the interim period, it depends on the arrangement of construction projects and construction procedures. There are generally two types of construction procedures: woodworking bases, masonry, and carpentry cover boards. If this is the case, then the mason will be finished and the woodworkers will pay when they enter the market. Another kind of process: the carpenters are all finished, and the mason re-enters the field, so that the mid-term is generally the end of the carpentry, and the mason is paid after entering the field. The construction process is different, and the payment period for the interim payment will also be different.
What kind of contract or agreement should you sign for the decoration team?
The market share of the decoration company's home improvement industry is still very low, and most of the owners choose guerrillas or other similar guerrilla-like teams for construction. There are many owners who have not signed any agreement with the construction team. After a dispute arises, the responsibilities, rights and interests of the two parties cannot be distinguished, and the disputes generated are not easy to coordinate. At least because the owners did not pass any agreement to constrain the construction team, the construction team did not have any pressure and was even more irresponsible to the site.
The owner signed the construction agreement with the construction team?
Cooperation between the two parties requires an agreement. Who will draft the agreement? Both parties can, as long as both parties agree on the terms of the contract. Of course, it is also possible to use a third-party agreement “Contract for the Promotion of the Construction Department in the area”, which can be purchased at a local architectural bookstore. Buy back the contract is best to perfect.
Do not think that everything will be fine after signing an agreement or contract with the construction team. Other documents (work drawings, budget books, bills of materials, etc.) also need to be improved. In short: Even if you do not find a decoration company, you must do it as formal as possible, so that it will be beneficial to both parties.
The simplest contract - the owner of the budget believes that he does not need to sign a contract to assemble or find a guerrilla. The contract is too complex and there is no need to sign it.
Then what is not agreed?
In fact, the signing of the agreement is very simple: the simplest agreement is the "budgeting book." Regardless of whether to find the construction team or the workers to carry out the construction, the construction team should provide the owner with a budget, and at least explain that: ? How much is it? To what extent or acceptance criteria.
Since there is no signing of an agreement, it should be written into the budget given by the construction party. The craft, materials, measurement methods, time limit, and compensation for breach of contract can all be written in. Both parties recognize it and take effect after signing it. In order to effectively avoid the phenomenon of future wraps.
The simple format of the budget is:
Construction project, estimated project volume, unit price, total price of the project, materials used in the project, and a brief description of the process.
At the bottom of the budget, more details are written on the margin of preference, measurement methods, duration, and other terms.
When necessary, use it with the construction drawings.
Whether or not to sign an agreement or sign a budget, you can't just point at them to let the construction party consciously implement it. The owners should also have the necessary control methods. After all, the owners are not professional, and the documents signed with the construction party are relatively simple and general.
